Sublet Policy:

        SUBLET POLICY   The Board of Directors may approve a sublet, defined as no more than one year with possible extensions for a total sublet period of no more than two years, under the following limited circumstances:   1.    The shareholder or shareholders of the apartment (the shareholder) must establish to the Board's satisfaction that the shareholder is temporarily relocating outside New York City for the period of the proposed sublet;   2.    The shareholder must have been a resident owner for at least five years at the time of the sublet application; and   3.    The shareholder must demonstrate a hardship or extenuating circumstances at the time of the sublet application.   The shareholder must complete and undergo standard credit and financial reviews, and the proposed sub-lessee must have an interview with the Board or a committee established by the Board for that purpose. The applicant must pay all fees outlined in Board Packager.   If the sublet is approved, the shareholder shall deposit with the Co-op corporation prior to the commencement of the sublet, a sum equal to one months maintenance to be held in a non-interest bearing account, and this amount shall be returned to the shareholder at the termination of the sublet if and when all payments due to the Co-op corporation have been made.     In addition to the monthly maintenance due for the shareholders apartment, the shareholder shall pay a monthly non-refundable sublet fee to the Co-op corporation in an amount equal to 10 percent of the then current monthly maintenance.  The monthly sublet fee shall be due and payable each month when the maintenance is due.    If the shareholder shall fail to pay the monthly maintenance due for the apartment and the monthly fee described above in a timely manner, upon written notice to the shareholder and sublessee by the Co-op corporation, the sub-lessee shall pay the monthly maintenance and monthly sublet fee due from the shareholder directly to the Co-op corporation and deduct the same amount from the sub-rent owed to the shareholder.    As indicated above, a limited extension of the initial sublet period may be granted at the Board's discretion. The Board may require the applicant shareholder to submit a new sublet application for any extension request. If so, the shareholder shall be required to pay additional fees as outlined in Board Packager as well as the monthly fee listed above. No short-term sublet, inclusive of the initial sublet period and any extensions, shall exceed two years.    The Board of Directors February, 2024
